Scope of Service

Just Lightning provides free technical support for its server and software. However, due to the breadth of services requested, we must set guidelines regarding the scope of these free services.

Just Lightning has no obligation to provide services in the following areas. Any discretionary support provided is on a "commercially reasonable efforts" basis and is dependent upon the availability of resources and appropriately skilled personnel.

  1. Website design services.
    1. Just Lightning provides Webmaster, HTML, and Graphics services. These services are provided at a cost to the Client based on the scope and complexity of the service(s) provided.

  2. Services related to installing, uninstalling, configuring, or troubleshooting third-party scripts or programs. Such services will be billed according to difficulty and scope of problem.
    1. Just Lightning enables you to run almost any script or program of your choice on your account. However, we can only support scripts that are pre-installed and configured by us. Third-party scripts are your responsibility to install and maintain.
    2. Just Lightning reserves the right to include or remove third-party scripts and services for Client web sites. The time associated with problem identification/resolution will be billed (rate contingent on complexity of problem) if the primary cause is determined to be the utilization of third-party software.
    3. Just Lightning does not allow BETA software to be installed.

  3. Non-Just Lightning standard system configuration.
    1. Non-standard configuration includes but is not limited to: change in server paths, changes to the server configuration files, and changes to the procmail files.

  • Acceptable customized configuration outages.
    1. If you request an acceptable customized configuration such as MX settings or DNS CNAME, Just Lightning is not responsible for outages that occur between your server and the end service, or outages experienced with the end service in question.
    2. If you choose to direct your e-mail alias and MRA accounts to an outside service, Just Lightning is not responsible for the quality and reliability of that outside service.

  • Misuse of server or services.
    1. Just Lightning is not responsible for any and all client or third-party negligence, misuse, or abuse of the hardware and software provided.
    2. Just Lightning is not responsible for any and all hacker attacks and/or security breaches on servers where the client does not follow proper password and security measures, and/or where the client shares the account password with third parties.
    3. Just Lightning will use best efforts to thwart hacker attacks that are not the result of a negligent user.
    4. Third-party sabotage such as "denial of service" attacks are supported on a "best efforts" basis only.

  • FORCE MAJEURE: Just Lightning shall not be deemed in default or otherwise liable under this Agreement due to its inability to perform by reason of any fire, earthquake, flood, epidemic, explosion, casualty, strike, lockout, labor controversy, riot, civil disturbance, act of God, embargo, war, act of public enemy, or any municipal, county, state, national, or international ordinance or law or any executive, administrative, judicial or similar order (which order is not a result of any act or omission to act which would constitute a default under this Agreement), or any failure or delay of any transportation, power, or other essential thing required, or similar causes beyond the Company's (Just Lightning's) control. Any delay in performance shall be no greater than the event of force majeure causing the delay. If an event of force majeure continues uninterrupted for a period exceeding five (5) days, Customer may elect to terminate this Agreement upon notice to Company, but such right of termination, if not exercised, shall expire immediately upon the discontinuance of the event of force majeure.

  • Setup times.
    1. Just Lightning hosting accounts will be set up and domain names will be registered within 24 hours of the time the order is processed. All new orders are processed upon receipt of payment, so long as payment is received before 3pm Central Time on any given business day. If you are ordering after 3pm Central Time on a Friday, your order will be processed on the following Monday.

  • Even though Just Lightning employs reliable, industry standard third-party operating system and server software, Just Lightning is not responsible for supporting software problems associated with such third-party software.

  • Just Lightning reserves the right to take emergency administrative measures including, but not limited to deletion of logs, core dumps, and large e-mail file purges to ensure proper and optimum server operation.

  • Just Lightning shall not be responsible for failing to register a domain name, should another party register the same domain between the time that you submit a request for the domain name and the time that the domain is actually registered.

  • Just Lightning shall use commercially reasonably efforts to provide any services performed under this policy. However, you agree that Just Lightning's maximum liability to you under any provision of this policy, or any transaction contemplated under this policy shall be limited to the amount actually paid by you to Just Lightning for such transaction. IN NO EVENT SHALL JUST LIGHTNING BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES IN CONNECTION WITH OR ARISING OUT OF ITS PERFORMANCE OR FAILURE TO PERFORM PURSUANT TO THIS POLICY, EVEN IF JUST YOUR TYPE HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE.

  • This Service Agreement and Just Lightning's policies are subject to change by Just Lightning without notice. Continued usage of the Services after a change to this Agreement by Just Lightning or after a new policy is implemented and posted on the Just Lightning (JL) Site constitutes your acceptance of such change or policy. We encourage you to regularly check the Just Lightning (JL) Site for any changes or additions.
